The timeline for a divorce in Alberta depends entirely on the unique situation of each couple. If both spouses agree on all terms and the paperwork moves smoothly through the court, the process can take as little as 12 to 16 weeks. However, the timeline can stretch to many months or even longer if there are unresolved disputes over parenting, support, or property division, or if the case goes to trial.

Property division follows specific legal rules to ensure a fair outcome for both parties. Generally, assets acquired during the marriage – such as the matrimonial home, bank accounts, vehicles, pensions, investments, and insurance – are divided equally. Property owned before the marriage, or received as a personal gift or inheritance, is often exempt from equal division. However, it’s important to note that any increase in the value of those exempt assets during the course of the marriage may still be subject to division.

Alberta recognizes specific legal grounds that must be met before a divorce can be granted. The most common ground is a marriage breakdown established by living separate and apart for one full year. While you can also file immediately, your Divorce will not be granted until the one year has elapsed. You can speed up the Divorce if you file based on adultery or physical/mental cruelty; however these paths require strict legal proof.

You don’t need your spouse’s permission to end a marriage in Canada. One spouse can legally move forward with a separation or divorce even if the other partner refuses to cooperate or sign the paperwork. The critical factor in these situations is showing a clear, unambiguous intention by at least one person to end the relationship and live separate and apart. This intent is generally proven through distinct changes in living arrangements, independent finances, separate daily routines, and how you present your relationship to the public.
